December 2009 minutes

Minutes of the Franklinville Town Board Meeting held on December 8, 2009, at 7:00 P.M.

Meeting was called to order by Mr. Dickinson at 7:00 P.M. The Pledge of Allegiance was recited. Roll Call was taken, with one absent.

Approval of Minutes
Mr. Brisky made a motion to approve the minutes of the November 10, 2009, meeting. Mr. Dallas seconded the motion. All voted “Aye”. Carried. Mr. Brisky made a motion to accept the minutes of the Special meeting of November 12, 2009, with one correction to read that the total of the work being done on the roads will be about $200,000.00. Mr. Trummer seconded the motion. All voted “Aye”. Carried.

Approval of Abstract
Mr. Trummer made a motion to pay abstract #12, General vouchers #331-349 in the amount of $7223.29 and Highway vouchers #199-215, in the amount of $39,852.51 seconded by Mr. Brisky. All voted “Aye”. Carried.

Reports
The Clerk, Justice and Building Reports were presented.

Petitions and requests from the floor
Doug Krueger from Townline Rd. was present to speak about the deplorable condition of the road. He spoke with Supt. Weller about it and was not satisfied with his answer. Supt. Weller apologized to Mr. Krueger and his wife for his response. He assured Mr. Krueger that the road will be worked on this year, but that it does need to be rebuilt.

Court Clerk Judy Harrington showed the Board a new report which needs to be done for the Court, as well as older files that need to be addressed. She also mentioned that she was unhappy with the way the freeze on wages was handled. Mr. Brisky admitted that he regretted the way it was handled. The Town Clerk said that if there was a problem with the process, the process should have been fixed. Supt. Weller said that he felt blindsided over the wage freeze.
Supervisor Dickinson asked the Board if this could be revisited and the budget amended after the 2009 budget is done if there is money available. The Board members agreed to look at it.

Highway Superintendent
Supt. has had two meetings with FEMA. They will back again next week. He showed the Board photos of the storm damage. He is asking for mitigation for a number of sites. The capital project is coming along. The State auditor told Supt. Weller that Mr. Trummer can no longer work for the Highway Dept., as he is a Town Councilman.
Transfers and amendments will be made to the budget after the end of the fiscal year. There are some reporting issues with the budget. Some things just need to reported differently. FEMA money will be coming in for work that is already done.
There will be some surplus money in DB 5110.4 and DB 5110.1. Supt. is asking that this money be put into escrow to finish the work in 2010.
A bill was received from Olean General Hospital for Terry McClory. Supt. will forward the bill to Workmen’s Compensation.
A letter was received from Brewster Brown of Rogers Rd. asking that the road be better taken care. He stated that some nights he had to plow part of the road himself so that his wife could get home from work. Supt. will keep a better eye on it.

Code Enforcement Officer
CEO Hatch received a letter from the Cattaraugus County Health Dept. regarding outdoor wood boilers. The Health Dept. would like to eliminate the boilers. CEO Hatch recommended that he work with people who want to install them so that the boilers are located where they won’t offend any neighbors.

Supervisor
Starting in January there will be a Tier 5 retirement for new employees.
Supervisor recommended not spending any money on the joint Town/Village website until the money has been received. Mr. Brisky made a motion to appoint Town Clerk Kathy Hatch as key user and Mr. Brisky and Mrs. Hahn to the Website Committee. Mr. Trummer seconded the motion. All voted “Aye”. Carried.
Supervisor would like to attend the Association of Towns annual conference in NYC. The cost for meals and two night’s accommodations will be $1,088.00. Mr. Trummer made a motion to allow two people to go to the conference, seconded by Mr. Dallas. All voted “Aye”. Carried.
Supervisor wrote a check to the Water District from the Highway account in the amount of $39.60. A Water District customer had paid at the Village and the Village sent the Town a check, which was mistakenly deposited in the Highway account.
The Local Law, which makes the Highway Supt. an appointed position, passed by two votes, and was certified. Town Attorney McAuley will submit the paperwork to the State. Mr. Brisky spoke with David Moshier about the appointment. It could be done in one of two ways: Confidential policy- there must be a job description and must meet qualifications, or
Exempt- no qualifications
The Board should start now to set up a job description. Mr. Brisky proposed giving Mr. Moshier ideas as to what the requirements would be and having him help set up a job description.

Mr. Dickinson and Mr. Brisky will look into a conference call device.

Correspondence
Mr. Fadale contacted the Clerk again regarding the spelling of Fidale Rd.
A letter was received from the Bentley family thanking the Board for the flowers that were sent when Mr. Bentley passed away.

Executive Session
Mr. Dickinson made a motion to go into Executive Session to discuss concerns regarding certain sections of the Union proposal dated Sept. 30, 2009, and collective bargaining, and then adjourn. Mr. Brisky seconded the motion. All voted “Aye”. Carried.
